Term Of Condition Certification

1. Introduction

PT. ASRInternasional Indonesia follow the criteria specified in the ISO/IEC 17021-1 Standard for a Certification Body recognized as competent and reliable in the operation of Management Systems. This Agreement shall be governed by English Law.

2. Scope Of The Rules Of Registration

The assessment and certification of management systems operated by an Applicant e.g BS EN ISO 9001, ISO 14001 and BS OHSAS 18001 etc. The Applicant must agree to supply all necessary information to PT. ASRInternasional Indonesia (ASRICERT Indonesia)

3. Definitions

For the purpose of these Terms and Conditions:
Applicant means an individual, body corporate or body unincorporated applying for a Certificate of Registration.
Assessment means a verification of the effectiveness of the relevant Management System operated by an Applicant through the examination of materials, finished product, methods of test, records, systems, environmental and other activities established by the Applicant within its Management System. Technical Committee means the committee appointed to establish and monitor the performance of the PT. ASRInternasional Indonesia (ASRICERT Indonesia) certification scheme and make recommendations for improvement as necessary.

Certificate of Registration means a document issued by PT. ASRInternasional Indonesia (ASRICERT Indonesia) in recognition that the management system operated by the Applicant meets the requirements of the applicable Standard and these Terms and Conditions.

Client means applicant or registered company as appropriate.
Product means the goods, processes or services provided by a client.
Certification of a Management System means independent demonstration that the management system of the organization

  • Conforms to specified requirements
  • Is capable of consistently achieving its state policy and objectives, and
  • Is effectively implemented.

Registered Company means an individual, body corporate or body unincorporated which has been granted a Certificate of Registration.
Scope of Registration means the range of products, services, activities covered by the management system of a registered company specified on the Certificate of Registration.
Standard means the Standards or other requirements for which the applicant organization is seeking certification.

4. Application For Registration

On receiving an enquiry for certification a Contract Review will be undertaken based on the information supplied to us by the applicant organization. A quotation will then be issued. On acceptance of this quotation the applicant will be required to sign the Contract Acceptance Form and send it to PT. ASRInternasional Indonesia (ASRICERT Indonesia) together with payment for the Stage 1 Planning Visit of the certification/registration costs. Arrangements will then be made to undertake the Stage 1 assessment. The balance of certification/registration costs i.e Stage 2 Initial Assessment should be made at least 7 days prior to the commencement of the visit.

5. Assesment Method

The first stage of the assessment process carried out by PT. ASRInternasional Indonesia (ASRICERT Indonesia) is to review the client’s documentation and readiness for the Stage 2 assessment. Applicant companies agree to provide PT. ASRInternasional Indonesia (ASRICERT Indonesia) with access to documents, areas and records for conducting assessments.
For all registrations, a Stage 1 Planning Visit is carried out at the client’s premises to review the adequacy of the documented management system and status of implementation. On completion of the Stage 1 visit the audit findings shall be documented and communicated to the client, including identification of any areas of concern that could be classified as a non-conformity during the Stage 2 audit.
The Stage 2 assessment is carried out against the appropriate standard, the client’s documented management system, records and by interviewing relevant members of staff regarding their working practices.

6. Certification

On completion of the Stage 2 assessment the Lead Auditor issues a report to PT. ASRInternasional Indonesia (ASRICERT Indonesia) Head Office along with a recommendation form for approval which will be submitted for impartial independent review. If certification is granted, the client is included on the PT. ASRInternasional Indonesia (ASRICERT Indonesia) directory of certified clients, which is available to the public via the PT. ASRInternasional Indonesia (ASRICERT Indonesia) website.
Each Certificate of Registration defines the Scope of Registration.
The Certificate of Registration is personal to the Company who must not give permission for it to be used by a third party.
Registration is on an annual basis subject to continued compliance with the Standard following a successful annual surveillance visit. Certificates remain the property of PT. ASRInternasional Indonesia (ASRICERT Indonesia). Certificates of registration shall not be issued unless we has received payment in full.

7. Notification Of Changes By Client

Certified clients must inform PT. ASRInternasional Indonesia (ASRICERT Indonesia) without delay of matters that may affect the capability of the management system i.e. legal or commercial organization status or ownership, contact address and sites, scope etc.

Notification of changes requiring a reissue of registration certificates other than for initial or reassessments will attract a nominal administration charge.

8. Surveillance

The audit team conducted surveillance audit at on-site audits. This audit does not necessarily full system audits. It can be partial audits of the management system. The number of surveillance audits can be increased according to customer requirement or size of the organization changed, received customer complaints, the level of the nonconformity detected during surveillance audit or as audit team indicated.

9. Recertification

A re-certification audit is conducted to evaluate the continued fulfillment of all of the requirements of the relevant management system standard every three years to confirm continued conformity and effectiveness of the management system as a whole and its continued relevance and applicability for the scope of certification. A review of the company’s performance during the preceding three year period is also undertaken.
It is provided to plan an audit for 2-3 months before the certificate expiration date based on the certificate validity period. The time interval; between the first certification audit and recertification audit or between the two recertification audit must not be more than 3 years.
If the company does not respond or request the certificate continuance, at the end of the certificate validity period, the certificate becomes invalid.

10. Publicity

Once a certificate has been issued then the Company has the right to publish the fact and to apply the relevant certification marks to their stationery and promotional material relating only to their assessed scope of registration.

The conditions for the use of the PT. ASRInternasional Indonesia Certification mark are set out in document AF-MCS-04.
PT. ASRInternasional Indonesia’s (ASRICERT Indonesia) clients/registered companies agree not to use granted certification in such a manner as to bring PT. ASRInternasional Indonesia (ASRICERT Indonesia) into disrepute.

11. Certificate Misuse

PT. ASRInternasional Indonesia (ASRICERT Indonesia) will take all reasonable precautions to ensure that there is no misuse of their certificate in client advertising etc. The client undertakes only to use certification marks and/or accreditation marks as appropriate to their assessed scope of registration, location and/or applicable management system standard.

12. Certificate Suspension Or Withdrawal (Extension and Reduction the Scope)

Suspension

The grounds for suspending the certificate are as follows:

  • If the certified organization is not getting the Surveillance audit conducted as per the certification agreement.
  • If the client is found to misuse the logo of the Certification Body or is using any kind of misleading statement which might affect the reputation of the certification body and the accreditation board

Any certificate issued by ASRICERT may be withdrawn in the event of any of following defaults by a certificate holder.

  • If a surveillance audit is not arranged within 3 months of the due date in response to notice issued by ASRICERT Indonesia
  • major lack of effective implementation of corrective of actions within agreed time limits in respect of non-conformities identified during surveillance audits.
  • failure to pay appropriate fees.
  • continued misuse of Accreditation mark/logo e.g. misleading publications, advertisement or contravention of the stipulated conditions for the use of marks/logo. Upon suspension or cancellation of certificate of registration, the name of the organization shall be deleted from the ASRICERT’s Indonesia approved list of certified companies.

Withdrawn

The grounds for cancellation of certificate are as follows:

  • in case the organization is not able to resolve the issue of suspension within 90 days from the date of suspension.
  • The evidences submitted by the organization for the reason of suspension as defined above are not found satisfactory.
  • Upon the suspension the certificate will be surrendered from the client, the ASRICERT Indonesia web site will be updated that the organization’s certificate is cancelled (not valid). After the cancellation of the certificate if the organization is found to use the certificate or certification information in any manner legal action will be taken against the organization as per the contractual agreement.
  • Note: The evidences can be verified onsite or offsite depending upon the nature of the reason for the suspension.

Extension

Upon the request of the client at any point of certification cycle, the scope of certification can be extended after the verifications conducted as per the ASRICERT Indonesia certification process.

Reduction

Upon the request of the client or during the surveillance audit as identified/verified by the audit team, the scope of certification can be reduced after the verifications conducted as per the ASRICERT Indonesia certification process.

  • If there is any complaint from the customer’s customer ASRICERT Indonesia needs to verify the complaint and in case if the certified organization is found guilty the certificate will be suspended and will remain suspended until the complaint is not resolved.
  • In case of non-payment of the fee as per the contractual agreement.
  • If during the Surveillance audit system found not to comply with Standard requirement.
13. Cancelation Of Registration

The contract for use of organization’s management system certificate can be cancelled according to the decision of PT. ASRInternasional Indonesia (ASRICERT Indonesia’s) certification decision committee.

The reasons for rescission of a contract and resumption of certificate;

  • the organization’s disallowance for conducting the audit in the given suspension period, or default in meeting the requirements of suspension (payment, document review etc.);
  • organization’s failure in closing the nonconformities in given time for the activities (audit, document, review etc.) taken to end suspension;
  • organization’s bankruptcy or shut the activity which is in the certificate scope;
    use of the management system certificate in different areas from the product or service declared in the scope;
  • organization’s giving inadequate and insufficient information during the audits;
    deceptive and unauthorized use of certificate;
  • failure in payment of the prices, effectuated by PT. ASRInternasional Indonesia (ASRICERT Indonesia), in 15 days from the invoice date;
  • detecting in the audits performed during the certificate validity period that the organization’s management system has lost its adequacy entirely;
  • organization’s being off at the facility address declared in the certificate, and the change of organization’s business entity concept;
  • organization’s violating terms of this manual, and falsify on the certificate and its additions by the organization;
  • the request of the organization for delay, for any reason, of the surveillance/follow up audit date notified by PT. ASRInternasional Indonesia (ASRICERT Indonesia) or request for cancellation of surveillance/follow up audit and organization’s request

PT. ASRInternasional Indonesia (ASRICERT Indonesia) has the authority to publish in its website the decisions about resumption of the certificate and cancellation of the annulment of the contract.

The organizations shall stop the use of certificate and logo after the announcement of certificate resumption and rescission of the contract. The organization is obligated to return every kind of document given to itself with the contract in 15 days from the date of notification at the latest.

14. Short Notice Audits

The audit team of PT. ASRInternasional Indonesia (ASRICERT Indonesia) may be necessary to conduct audits of certified clients at short notice or unannounced to investigate complaints, or in response to changes, or as follow up on suspended clients. In such cases:

  • Certification administration coordinator shall describe and make known in advance to the certified clients (e.g. in documents as described – Information on the certification activity and requirements) the conditions under which such audits will be conducted;
  • Certification administration coordinator shall exercise additional care in the assignment of the audit team because of the lack of opportunity for the client to object to audit team members.

The audit team short notice audit are performed for; investigating the complaints, the situation of changes in the management system standard or certificated organization’s rules, or follow up the ending of suspension.

15. Appeals and Complaints

Certification body head established to implement documented procedure of appeal handling (AP-MR-09) and documented procedure of complaint handling (AP-MR-10).

Any person or organization can complain about and object to PT. ASRInternasional Indonesia (ASRICERT Indonesia’s) performance of certification and audit activities, procedures, policy, temporary/permanent personal or activities, within the certification scope of an organization certificated by PT. ASRInternasional Indonesia (ASRICERT Indonesia) or any subject about PT. ASRInternasional Indonesia’s (ASRICERT Indonesia’s) activities, or object to decisions taken by ASRICERT concerning themselves.

This appeals are recorded to appeal declaration form. Appeal should be made written in 30 days from the date of decision in question.

All the received Appeals and complaints are evaluated from the point of qualification by PT. ASRInternasional Indonesia (ASRICERT Indonesia) and complainant and objector are informed about the activities taken and will be taken.

The complaints about the certificated companies are recorded according to ASRICERT procedures (AF-MR-09 & AP-MR-10).

This circumstance is informed to certified organization and related correction activities will be requested to be informed to ASRICERT in writing in one month.
The complaint will be informed about the received information.

Certification body head and Board of Director as well as appeal committee shall determine the complaints-handling process are determined at least the following elements and methods in procedure of complaint handling process (AP-MR-10):

a) an outline of the process for receiving, validating, investigating the complaint, and for deciding what actions need to be taken in response to it;

b) tracking and recording complaints, including actions undertaken in response to them;

c) ensuring that any appropriate correction and corrective action are taken.

These complaints are recorded to complaint declaration form. Appeal should be made written in 30 days from the date of decision in question.
One member of board of directors and appeal committee who are not previously involved in the subject of the complaint will communicate the decision to be made to the complainant.
Management of ASRICERT or certification administrator coordinator received responsible for gathering and verifying all necessary information to validate the complaint.

16. Access To Records Of Complaints

PT. ASRInternasional Indonesia (ASRICERT Indonesia) certificated companies are required to record all complaints received from clients. When appropriate, evidence of prompt effective corrective action being carried out by the certificate holder shall be examined at each PT. ASRInternasional Indonesia (ASRICERT Indonesia) surveillance audit. The client also must inform PT. ASRInternasional Indonesia (ASRICERT Indonesia) in the event of an alleged breach of relevant legislative or regulatory requirements.

17. Personnel

PT. ASRInternasional Indonesia (ASRICERT Indonesia) undertake to provide suitably qualified personnel for all assessment and surveillance work using their own staff or suitable, qualified sub-contractors. All members of PT. ASRInternasional Indonesia (ASRICERT Indonesia) employees or sub-contractors are required to sign confidentiality agreements concerned with all confidential information that they may be exposed to at client premises.

18. Fees

A formal quotation, which details the Stage 1, Stage 2 and surveillance fees, is supplied to the applicant. The applicant acknowledges acceptance of the quotation by signing the Contract Acceptance form. These fees are payable in advance at least 7 days prior to commencement of the assessment.

Certificates of registration shall not be issued unless PT. ASRInternasional Indonesia (ASRICERT Indonesia) has received payment in full.

All quoted fees are exclusive of VAT. All fees paid to PT. ASRInternasional Indonesia (ASRICERT Indonesia) are strictly non-refundable.

19. Liability

If in providing information or service neither PT. ASRInternasional Indonesia (ASRICERT Indonesia) nor any of its servants or agents warrants the accuracy of any audit, review or information supplied. Except as stated in this document PT. ASRInternasional Indonesia (ASRICERT Indonesia) nor any of its servants or agents shall not be liable for any loss, expense or damage howsoever sustained by any company, client or person due to any act whatsoever taken by PT. ASRInternasional Indonesia (ASRICERT Indonesia) or its servants or agents save to the extent that any attempted exclusion of liability would be contrary to law.

20. Indemnity

The client will indemnity PT. ASRInternasional Indonesia (ASRICERT Indonesia) against any claims or losses suffered by PT. ASRInternasional Indonesia as a result of misuse by the client of any approval or registration given to the client by PT. ASRInternasional Indonesia (ASRICERT Indonesia) under their rules of assessment.

21. Changes to Terms and Conditions

PT. ASRInternasional Indonesia (ASRICERT Indonesia) reserves the right to change these rules for registration herewith without prior notification as required by the Directors of PT. ASRInternasional Indonesia (ASRICERT Indonesia). No such changes shall affect the right of any Registered Company to use the certification marks until it has been served with notice in writing of such changes by PT. ASRInternasional Indonesia (ASRICERT Indonesia). PT. ASRInternasional Indonesia (ASRICERT Indonesia) will notify the Registered Company of the date by which it must comply with the altered Terms and Conditions via the PT. ASRInternasional Indonesia website.

22. Communication

E-mail shall be an accepted means of communication.
